User Agreement

1. Read Our Privacy Policy

Please read our Privacy Policy to understand how we collect, use, share and protect your personal data. By using the Pebble Qore Services, you acknowledge that our processing of personal data is described in our Privacy Policy, which forms an integral part of this Agreement. Where consent is required by applicable law, we will seek consent through the app or another appropriate method.

2. Eligibility to Use Pebble Qore Services

You must be at least 18 years of age and competent to contract under Section 11 of the Indian Contract Act, 1872, to create a Pebble Qore account. If you are under 18 years of age, you may use the Pebble Qore Services only where permitted by applicable law and with the involvement, consent and supervision of a parent or lawful guardian, who agrees to be bound by this Agreement on your behalf. If we believe a user does not meet applicable eligibility requirements, we may suspend or terminate the relevant account, subject to applicable law.

3. Create Your Account

To use the Pebble Qore Services, you need to create an account using a valid mobile number or email address and complete the applicable account verification process. You are responsible for keeping your account information and verification credentials secure and for all activities that occur under your account. SRK Powertech is not liable for loss arising from your failure to keep your account secure, except to the extent required by applicable law. Please contact us immediately if you suspect unauthorised access to your account.

The Pebble Qore app does not currently offer a Guest Mode. An account is required to use the Pebble Qore Services.

4. Essential Devices

To use the Pebble Qore Services fully, you need a compatible smartphone with internet connectivity and a Pebble Qore smart device, such as the Pebble Qore Ultra or other current Pebble Qore-branded devices. You are responsible for the safe operation and maintenance of these devices, as well as any internet or data charges levied by your service provider.

Certain device connectivity and communication functions may depend on software development tools or firmware components supplied by the manufacturer of the connected device. Device-specific hardware warranty terms, where applicable, are governed by the applicable product warranty provided with the device.

5. Pebble's Intellectual Property Rights

"Pebble Content" means all photos, images, graphics, videos, audio, text, software, data, trademarks, logos, and other content made available through the Pebble Qore Services. All Pebble Content and associated intellectual property rights, including trademarks registered or applied for under the Trade Marks Act, 1999, are owned by SRK Powertech or its licensors. Your use of the Pebble Qore Services does not transfer any ownership rights to you.

You agree not to modify, copy, reverse-engineer, extract, distribute, commercially exploit, or create derivative works from any Pebble Content, trademark, or proprietary material, except as expressly permitted by this Agreement or applicable law. Nothing in this Section prevents you from sharing screenshots or content generated from your own use of the Pebble Qore Services for personal, non-commercial purposes, provided that such sharing does not misuse Pebble's trademarks or proprietary materials.

6. Pebble Qore Services

The Pebble Qore Services record and organise your activity, training and health-related data for your personal, non-commercial use across the Home, Activity, Sleep and Me pages of the app. Key features include:

• Account login and secure management of your training and health-related data;
• Device management, including pairing, upgrading and resetting your Pebble Qore device(s) over Bluetooth;
• Personal information management, including editing your avatar, name, gender, age, height and weight;
• Home page overview, including optional AI-powered personalised insights generated from your activity, sleep and health-related data;
• Activity page, including activity and exercise data such as steps, running, cycling, swimming and outdoor movement paths;
• Sleep page, including sleep, heart rate, SpO₂ and stress tracking;
• Additional features such as notifications, menstrual cycle reminders, alarms and Find Device.

Certain features, including AI Insights, may process your health and wellness data through authorised third-party service providers as described in our Privacy Policy. You may disable optional features where available in the app.

We may update the Pebble Qore app from time to time; the exact features available to you will depend on your app version and device model.

7. Rules of Use

Subject to your compliance with this Agreement, SRK Powertech grants you a limited, non-exclusive, non-transferable, revocable licence, without the right to sub-license, to use the Pebble Qore Services and Pebble Content solely for your personal and non-commercial purposes.

You may not use the Pebble Qore Services or Pebble Content to violate any law or third-party right, interfere with the operation or security of the services, attempt unauthorised access, or copy, adapt, modify, translate, reverse-engineer, create derivative works from, sell, lease, distribute or publicly display the Pebble Content or Pebble Qore Services, except as expressly permitted by this Agreement or applicable law.

You are solely responsible for content you upload, such as images or nicknames, and agree that it will not be false, defamatory, obscene, pornographic, harassing, threatening, discriminatory, or otherwise unlawful under applicable law, and will not infringe any third party's intellectual property or other rights.

8. Health and Wellness Disclaimer

If you have an existing medical condition, are undergoing medical treatment, or have concerns about using wearable health-monitoring devices or following exercise recommendations, consult a qualified healthcare professional before using the Pebble Qore Services.

In a medical emergency, contact a medical professional or the appropriate emergency services immediately.

Prolonged wear of the device may cause skin irritation in some users. To reduce discomfort: (i) keep the device clean and dry; (ii) do not wear it too tightly; and (iii) remove it periodically to rest your wrist. If you notice irritation, pain, numbness or swelling, remove the device and stop using it; consult a doctor if symptoms persist.

Health and wellness measurements provided through the Pebble Qore Services are estimates intended for general wellness and fitness purposes. They may be affected by device fit, movement, skin contact, environmental conditions, algorithms and other factors, and should not be considered medical-grade measurements.

9. Feedback and Submission Policy

If you submit feedback, suggestions, bug reports or other content to us, you grant SRK Powertech a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify and incorporate such Feedback into the Pebble Qore Services and related products without compensation or attribution obligations. You confirm that any Feedback you submit does not infringe any third party's intellectual property or other rights, and will not be false, defamatory or unlawful.

10. Third-Party Services

The Pebble Qore Services may use third-party technologies and infrastructure providers to support specific features, including cloud hosting, wearable-device connectivity, mapping services, health-platform integrations, analytics and crash reporting, and AI-powered features. These may include Amazon Web Services, Apple Maps, Google Maps, Google Health Connect, Apple Health, Firebase, and Anthropic's Claude API, where applicable.

The Pebble Qore application is developed and operated by SRK Powertech through its India-based team. Pebble Qore data is hosted on Amazon Web Services infrastructure located in India, subject to our Privacy Policy and applicable service arrangements.

Your use of third-party services may also be subject to their applicable terms and privacy policies. SRK Powertech is not responsible for third-party products, services, content or privacy practices except to the extent required by applicable law. Please refer to our Privacy Policy for further detail on how providers process your data.

11. Change of Pebble Qore Services

We may modify, suspend or discontinue any feature of the Pebble Qore Services at any time, with reasonable notice where practicable. We are not liable for any such change, suspension or discontinuation except to the extent required by applicable law. Software updates may be offered for manual download or installed automatically through your app store.

12. Termination

We may suspend or terminate your account or access to the Pebble Qore Services, or terminate this Agreement, where you materially breach this Agreement, engage in unlawful conduct, or as otherwise permitted under applicable law. We will make reasonable efforts to notify you in advance except where immediate action is necessary or permitted by law.

You may close your account and request deletion of your associated personal data at any time through the Pebble Qore app. Data deletion will be handled in accordance with our Privacy Policy and applicable legal retention requirements.

Upon termination, Sections 1, 2, 5, 8, 9, 13, 14, 15, 16, 17, 18 and 19 of this Agreement shall survive.

13. Disclaimer

The Pebble Qore Services are provided for your personal use and on an "as is" and "as available" basis. To the fullest extent permitted under applicable law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or completely accurate operation of the Pebble Qore Services.

Nothing in the Pebble Qore Services, including the AI Insights feature, constitutes medical advice. Content provided through health reports, AI-generated insights or wellness features should not replace consultation with a qualified doctor. Always seek professional medical advice for health concerns and never delay seeking it because of information provided through the Pebble Qore Services.

You acknowledge that physical activities tracked or encouraged by the Pebble Qore Services carry inherent risks of injury, and you voluntarily assume such risks to the extent permitted by law.

Nothing in this Section limits any right or remedy that is available to you as a consumer under the Consumer Protection Act, 2019, which cannot be excluded or restricted by contract.

14. Indemnity

You agree to indemnify and hold SRK Powertech harmless from claims, losses, liabilities and reasonable costs (including legal fees) arising from: (i) your unlawful or unauthorised use of the Pebble Qore Services; (ii) content you submit; (iii) your breach of this Agreement; or (iv) your violation of any law or third-party right, except to the extent such claims arise from SRK Powertech's gross negligence or wilful misconduct. This Section applies to the extent permitted by applicable law.

15. Limitation of Liability

To the maximum extent permitted under applicable law, SRK Powertech, its affiliates, suppliers and licensors shall not be liable for any indirect, incidental, special, punitive or consequential damages, including loss of profit or data, arising from your use of, or inability to use, the Pebble Qore Services.

Subject to applicable law, SRK Powertech's aggregate liability arising from or connected to this Agreement shall not exceed the amount you paid to SRK Powertech for the relevant product or service in the 12 months preceding the claim. Nothing in this Agreement excludes or limits liability that cannot be excluded under the Consumer Protection Act, 2019, or any other mandatory provision of Indian law, including liability for death, personal injury, fraud or gross negligence.

16. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Both you and SRK Powertech agree to first attempt to resolve any dispute arising from or relating to this Agreement or the Pebble Qore Services through good-faith negotiation. If the dispute is not resolved within 30 days, it may be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, subject to applicable law. The arbitration shall be conducted by a sole arbitrator appointed in accordance with applicable law, with the seat of arbitration at Noida, Uttar Pradesh, India, and the proceedings conducted in English.

Subject to the arbitration clause above, the courts at Noida, Uttar Pradesh shall have jurisdiction over matters not subject to arbitration, to the extent permitted by law. Nothing in this Agreement restricts your right, as a consumer, to approach the consumer dispute redressal fora constituted under the Consumer Protection Act, 2019, or to invoke the National Consumer Helpline, which remain available to you as a matter of Indian statutory right.

17. General Provisions

We will notify you of material amendments to this Agreement and provide an opportunity to review the revised terms before they take effect, where required by applicable law. Continued use of the Pebble Qore Services after such notice constitutes your acceptance of the revised Agreement.

If any provision of this Agreement is held invalid or unenforceable by a competent court or the Data Protection Board of India, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force.

Notices under this Agreement will be delivered by email or published within the Pebble Qore app, and will be deemed served on the date of dispatch or publication, as applicable.

Our failure to enforce any provision of this Agreement is not a waiver of that provision. No waiver is effective unless made in writing by an authorised representative of SRK Powertech.

18. Applicability of Additional Provisions

Additional terms may apply to specific Pebble products or services. In case of conflict between this Agreement and such additional terms, the additional terms will prevail for that specific product or service.
